If a criminal uses gun to rob expensive property, we can use gun to shoot him/her to stop him/her from robbing our property. This is a lawful defense according to Section 68 of the Criminal Code, even if you kill the criminal, you will be not guilty. But even expensive property, if an owner shoot one shot and the criminal run away, he/she can’t shoot again because there is no more danger. This is not a legal defense, if an owner shoot again for the second time and the criminal die while running away, he/she will be guilty of murder. However, the penalty will be reduced, because the owner “to be exploded by being maltreated seriously by unjust cause comes to commit” murder “against the maltreating person” (The Criminal Code Thai-English by Boonroum Tiamchan) according to Criminal Code Section 72.
